1. General Provisions

These Terms and Conditions, hereinafter referred to as the “Terms”, define the rules for using the website available at https://fbareturns.eu, hereinafter referred to as the “Website”.

In these Terms, “FLEX.”, “FLEX. network”, “we”, “us” or “our” refers to FLEX Logistics Services Poland Sp. z o.o. and, where applicable, FLEX. branded service lines, operational locations, partners, subcontractors or affiliated providers involved in the delivery of services under a separate commercial arrangement.

These Terms apply only to the use of the Website. The actual provision of FBA returns handling, removals receiving, inspection, grading, rework, relabeling, restock preparation, storage, disposal coordination and related operational services is governed by separate B2B commercial agreements, offers, order forms, service confirmations, statements of work or contracts agreed individually with clients.

Information published on the Website is provided for general informational and business purposes only. It does not constitute a binding commercial offer unless this is expressly stated in a separate written offer or agreement.

2. Definitions

User means any person, company or organization using the Website.

Website means the website available at https://fbareturns.eu and its subpages.

Electronic Services means services provided electronically through the Website, such as access to website content, contact forms, quote request forms, newsletter subscription forms or other online functions.

Client means a business customer or prospective business customer interested in FBA Returns or related FLEX. logistics services.

Content means all text, images, graphics, videos, logos, layouts, software, downloadable materials and other materials available on the Website.

3. Scope and Nature of the Website

The website presents information about FBA returns services delivered through the FLEX. network, including return receiving, inspection, grading, rework, restock preparation and reverse logistics support for marketplace sellers.

The Website may provide free electronic functions, including access to service information, contact forms, quote request forms, newsletter or marketing subscription forms, resources, articles, guides and links to external tools or partner platforms.

Using the Website does not create a logistics service agreement, warehousing agreement, transport agreement, customs representation agreement, fulfillment agreement, forwarding agreement, returns agreement, removals agreement or any other operational service agreement between the User and FLEX. Such agreements require separate commercial arrangements.

4. Technical Requirements

To use the Website properly, the User needs a device with Internet access, an up-to-date web browser, cookies and JavaScript enabled for some Website functions, and an active email address if the User wishes to use a contact form, quote request form or newsletter subscription.

We do not guarantee that the Website will function correctly on outdated browsers, unsupported devices or configurations that block essential website functionality.

5. User Obligations

The User agrees to use the Website in accordance with applicable law, good practice, these Terms and the intended purpose of the Website.

The User must not submit unlawful, misleading, abusive, offensive, defamatory or infringing content; send spam or malicious content; attempt unauthorized access; interfere with the security or availability of the Website; introduce malware or automated scraping tools; copy or commercially exploit Website content without permission; or impersonate another person, company or organization.

We reserve the right to restrict access to the Website, block suspicious activity, remove unlawful submissions or take other reasonable measures if a User violates these Terms or applicable law.

6. Contact Forms, Quote Requests and Business Communication

When a User submits a contact form, quote request or other inquiry through the Website, the User must provide accurate and lawful information.

Submitting a form does not oblige FLEX. to accept the request, provide a quote, enter into a contract or provide services. We may respond, request additional information, decline the inquiry or redirect the User to another FLEX. entity, partner, subcontractor, operational provider or website where appropriate.

Commercial information exchanged through the Website is preliminary unless confirmed in a separate written agreement, service confirmation, order form or offer.

7. Newsletter and Marketing Communication

If newsletter or marketing subscription options are available, the User may subscribe voluntarily by providing the required information and, where required, giving consent.

The User may unsubscribe from marketing communications at any time using the unsubscribe link in the relevant email, where available, or by contacting us directly.

8. Intellectual Property

All Content available on the Website, including text, graphics, layouts, logos, images, videos, icons, designs, service descriptions and software elements, is protected by copyright, trademark and other intellectual property laws.

The Content belongs to FLEX., its affiliated entities, licensors, partners or other authorized rights holders.

The names “FLEX.”, “FLEX. Logistics”, FLEX. logos and related brand elements may not be used without prior written consent.

9. Amazon and Third-Party Trademarks

Amazon, Amazon FBA, Fulfillment by Amazon and related names, logos, marks and platform references are trademarks or protected brand elements of Amazon.com, Inc. or its affiliates.

The Website is not operated by Amazon and is not endorsed by, sponsored by or officially affiliated with Amazon. References to Amazon, FBA, fulfillment centers, seller operations or marketplace processes are used only to describe the type of logistics support that may be relevant to business clients.

Marketplace rules, carrier requirements, fulfillment center requirements and platform processes may change. Users should verify current requirements directly with the relevant marketplace, carrier or professional adviser before making operational, legal, customs, tax or compliance decisions.

10. External Links and Third-Party Content

The Website may contain links to third-party websites, tools, platforms, articles, resources, partner pages or external services.

We are not responsible for the content, availability, accuracy, security, policies or practices of third-party websites or services. Accessing third-party websites is at the User’s own discretion and risk.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted under applicable law.

14. B2B Nature of FLEX. Services

FBA Returns and related FLEX. network services are primarily provided to business clients, online retailers, marketplace sellers, brands, importers and other commercial operators.

Unless expressly agreed otherwise, the FBA returns handling, removals receiving, inspection, grading, rework, relabeling, restock preparation, storage, disposal coordination and related operational services presented on the Website are intended for B2B clients and are subject to separate commercial terms.

Any service descriptions, performance claims, timelines, capacity references, warehouse location references, carrier references, Amazon fulfillment center references, inspection references, routing references or process descriptions on the Website are indicative and may depend on operational availability, client requirements, product type, warehouse location, carrier conditions, marketplace rules and the final commercial agreement.

15. Complaints Concerning Website Functioning

Users may submit complaints concerning technical issues or the functioning of the Website by contacting us at [email protected].

A complaint should include the User’s contact details, a description of the issue, the URL or part of the Website concerned, the date and time when the issue occurred where possible, and screenshots or other supporting information where useful.

We will review Website-related complaints within a reasonable time and may contact the User for additional information if needed.

18. Consumer Dispute Resolution Notice

FLEX. primarily provides services in a B2B context and does not sell consumer goods or consumer logistics services through the Website.

We are not willing and not obliged to participate in alternative dispute resolution proceedings before a consumer arbitration or mediation body, unless participation is required by mandatory applicable law in a specific case.

The former European Online Dispute Resolution platform has been discontinued and is no longer available.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of Poland, unless mandatory consumer protection laws provide otherwise.

For business Users, any disputes arising out of or in connection with these Terms, the Website or its use shall be submitted to the courts competent for the registered office of FLEX Logistics Services Poland Sp. z o.o., unless mandatory law provides otherwise.

For consumers, if any consumer law applies in a specific case, mandatory consumer protection rules and jurisdiction rules remain unaffected.

20. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Website, services, technical tools, legal requirements or business operations.
